Forwarder

Freightwatch Benelux is a member of Fenex and a transport intermediary. In other words, someone who organizes the logistics process for someone else. The freight forwarder Freightwatch is an intermediary between the carrier and the shipper of goods.

In Book 8, Article 60 (8:60 of the Dutch Civil Code) it is written: "the agreement to have goods transported is the agreement whereby one party (the forwarder) undertakes towards its other party (the client) to a carrier to conclude one or more agreements for the carriage of goods to be made available by this other party, or to draw up a clause for its benefit in one or more such contracts of carriage"

The Dutch Forwarding Conditions, including the arbitration clause, filed by FENEX at the registry(s) of the District Court(s) in Amsterdam and Rotterdam, latest version, apply to all our work. Dutch law is applicable. Claims that forwarder Freightwatch Benelux BV under art. 23 paragraph 1 of the Dutch Forwarding Conditions will be settled exclusively by the competent Dutch court in the place of business of the forwarder Freightwatch Benelux BV. Forwarder not liable

If the goods are stolen during transport, damaged or delivered late, the forwarder is not liable. That's because the agreed upon role of the forwarder is to 'do' the transport. He doesn't do that himself, he leaves it to someone else. There is therefore a forwarding agreement between the customer (client) and the forwarder. A transport agreement exists between forwarder and carrier.

The forwarder's liability is in all cases limited to 10,000 SDR per event or series of events with one and the same cause of damage. Taking into account the aforementioned limit, in the event of damage, depreciation or loss of the items included in the agreement, liability will be further limited to 4 SDR per kg gross weight damaged, reduced in value or lost.

Freightwatch can take out additional transport insurance if desired.
